TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using the FCKN Brands platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by FCKN Brands ("we", "us", "our"), a South African platform for custom apparel design, manufacturing, and retail.

2. ELIGIBILITY

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement under South African law.

3. ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. PRODUCTS & ORDERS

All products are custom-made to order. Because each item is manufactured on demand, we do not accept returns or exchanges unless the product is defective or materially different from what was ordered.

Product images are mockups generated from your uploaded designs. Actual colours may vary slightly depending on the garment and printing process.

Prices are displayed in South African Rand (ZAR) and include VAT where applicable. Shipping costs are calculated at checkout.

5. DESIGNS & INTELLECTUAL PROPERTY

You retain full ownership of any designs you create using the Design Lab. By placing an order, you grant us a limited, non-exclusive licence to reproduce your design solely for the purpose of fulfilling your order.

You represent that your designs do not infringe the intellectual property rights of any third party. We reserve the right to refuse orders containing designs that infringe copyrights, trademarks, or other proprietary rights.

Designs that violate South African law, contain hate speech, or promote violence will be rejected and may result in account suspension.

6. VENDORS

Vendors are independent sellers who use the platform to sell their products. FCKN Brands acts as a marketplace facilitator and is not a party to transactions between vendors and customers.

Vendors are responsible for the accuracy of their product listings, compliance with applicable laws, and fulfilment of orders. Revenue shares are governed by individual vendor agreements.

7. PAYMENTS

Payments are processed through third-party payment providers. We do not store your full payment card details on our servers.

All payments are final once the order has been sent to production. Refunds may be issued at our discretion for defective products or order errors attributable to us.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, FCKN Brands shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the order giving rise to the claim.

9. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be submitted to the exclusive jurisdiction of the courts of South Africa.

10. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance of the updated Terms.
